OpenAI has reversed its position on controversial AI legislation in Illinois, signaling a potential shift in its approach to state-level regulation. In recent written testimony to the Illinois Senate, the company disavowed a provision in bill SB 3444 that would have granted AI developers a "liability shield" against lawsuits.
Company representatives clarified that while they initially supported the bill to encourage a coordinated safety framework, they do not endorse a "no liability" model for frontier AI. In addition to rejecting the liability safe harbor, OpenAI and competitor Anthropic have endorsed a more stringent safety bill, SB 315.
